Please read the following Terms and Conditions of Account Wagering (“Terms and Conditions”) carefully.

MyWinners is the online brand of Winners off-track betting venues, which is headquartered, owned, and operated out of Connecticut, USA. Since 1996, MyWinners/Winners has proudly offered fun, safe and regulated betting, serving millions of US customers.

This Agreement describes the terms and conditions applicable to your use of the MyWinners.com website (the “Website”) and the account wagering services (the “Services”) provided by Sportech Venues, Inc. (“Sportech”), under the trade name and doing business as Winners (collectively, “Winners”). Your access to and use of the Website is subject to your acceptance of these Terms and Conditions and to all applicable State and Federal regulations.

In order to better serve you, Winners and its affiliates will regularly update and enhance the Website and may from time to time revise the Terms and Conditions. Winners will notify you whenever the Terms and Conditions are changed, and before new rules are applied to your wagering account, including the opportunity for you to close or cash in your wagering account. You, as a customer account holder, shall be deemed to have accepted the Terms and Conditions of the Services upon establishing and maintaining a balance on your wagering account.


A. Licence Holder & Operator of Record

In the State of Connecticut, the Service is operated under the licence of Sportech Venues, Inc. (trading as “MyWinners”), with offices at Sportech Venues, Inc., One Hamden Center 2319 Whitney Avenue, Suite 5-a, Hamden, CT 06518, USA (“Sportech Venues,” “we,” or “us” in CT-specific provisions).

​Sportech Venues, Inc offers an advance deposit wagering service to eligible consumers in Connecticut utilizing the Potent Interactive Platform for this website and associated mobile applications (the website and associated mobile applications collectively, the "Application"), which utilizes a proprietary application programming interface integrated with certain trusted third party applications, such Application and proprietary interface designed, developed and maintained by Potent Systems, Inc., a Delaware corporation (“Potent”), (Sportech Venues and Potent collectively referred to herein as “us” or “we”). As used herein, the term "Service" refers collectively to all means and methods by which a consumer: (i) becomes an approved user of Winners' advance deposit wagering service; and (ii) utilizes the advance deposit wagering service to place wagers and use other features and functionalities offered by the Application.


B. Registration and Eligibility

Use of the Service in Connecticut is subject to all applicable Connecticut and Federal laws and regulations and can only be used by natural persons who are eighteen (18) years of age or older. By using the Service in CT, you represent and warrant that: (a) you are a natural person who is eighteen years of age or older; (b) you are a United States citizen or resident alien; (c) the residential address you provided is true and correct and that you are a resident of the state associated with such residential address; (d) all registration information you submit is truthful and accurate; (e) at all times you will maintain the accuracy of such information including name, primary residence address, email address and phone number by contacting Player Services; and (f) your Account is only for your own personal use and you will not: (i) use your Account in connection with a commercial business or otherwise for commercial purposes; and (ii) allow others to access or use your Account. If your primary residence address changes, you agree not to use your Account until after you have notified us of such change and your new address has been verified. Sportech Venues may, in its sole discretion, refuse to offer the Service to any person or entity and change its eligibility criteria at any time. This provision is void where prohibited by law and the right to access the Service is revoked in such jurisdictions.


C. Account Creation

To use the Service, you will be required to create a user account (“Account”) with Sportech Venues. To open an Account, a User must be legally allowed to open a pari-mutuel advance deposit wagering account and not otherwise be disqualified by these Terms and Conditions or applicable state law. You authorize Sportech Venues to open a pari-mutuel advance deposit wagering account in your name and to place wagers as instructed by you and manage funds on your behalf. You also authorize us to use third party services to authenticate your Account information. You agree that you may create and have only one Account. You may not assign or transfer your Account, either in whole or in part. Any attempt to do so shall be void and of no effect. Funds are not transferable between Accounts.


D. Intellectual Property

D1. Content

The Service contains, displays, and/or otherwise makes available certain software, illustrations, documentation, information, music, pictures, images, text, photographs, animations, three-dimensional models, videos, audio, content, and other digital material and assets (collectively the “Content”). All Content is protected by both United States law as well as the laws of various international jurisdictions, including, but not limited to, copyright law, trademark law, patent law, trade secret law and various governmental treaties. We (or our applicable licensors) own all right, title, and interest in and to the Content. You acknowledge and agree that, except for the express and limited license rights granted by us to you hereunder, we reserve any and all rights in and to the Content. Nothing herein is intended to transfer or assign to you any ownership or beneficial rights in and to the Content. You acknowledge that all Content accessed by you using the Service is at your own risk and you will be solely responsible for any damage or loss to any party resulting therefrom.

D2. License Grant

We hereby grant you a non-exclusive, non-transferable, limited right license to access, use and display the Service specifically for personal, non-commercial use only. This license is fully and completely revocable at any time by us, with or without notice and for any or no reason. We make no warranty as to legality, suitability, or use of the Service and the limited license granted herein and you acknowledge, agree, and otherwise consent that we shall have no liability arising from or in connection with your use of the Service.

D3. License Restrictions and Prohibitions

You shall not undertake any of the following activities in using the Service: (i) market, share, distribute, offer to sell, sell or otherwise make reproductions or copies of the Service in any way inconsistent with the rights of use provided by the license herein; (ii) remove or obscure any patent, copyright, trademark, or other proprietary rights notices relating to the intellectual property or other property of us or our licensors; (iii) attempt to access source or object code of the Service, by methods including reverse engineering or otherwise reducing it to a form readable without the use of a computer, except and unless any applicable statutes or laws specifically prohibit said restrictive language; (iv) amend, change, modify (including the creation of any derivative or other works) the Service; (v) attempt to disable any digital rights management or copy protection aspects of the Service, not already specifically prohibited by existing laws; (vi) create code, software or other program that incorporates any elements of the Service; (vii) attempt to hack into, compromise or otherwise access the object or source code of the Service for any purposes, personal or commercial, without the express written permission of us; (viii) interrupt or attempt to interrupt the operation of the Service in any way; and/or (ix) transmit code, data, or files that contain malicious code or that may in any way damage or interfere with the operation of the Service, other Users' access to the Service, and/or other Users' computers.

D4. Trademarks

The Service contains, displays, and/or otherwise depicts certain trademarks, service marks, logos, and/or other indicia of origin (collectively “Trademarks”) owned by us or our partners and vendors. You shall not use, reproduce, or otherwise exploit any Trademarks or any similar derivations of any Trademarks.


E. Third Party Services/Functionalities

Certain information available through the Service, including but not limited to wagering and race information, may have been provided by independent third party information suppliers. Providers, which includes such suppliers, are not responsible for the accuracy, currency, or reliability of such information, and the inclusion of such information in the Service shall not be deemed an endorsement or recommendation of any third party or constitute any representation as to a third party's qualifications, services, products, offerings, information or any other content. You acknowledge that under no circumstances will Providers be liable for any loss or damage caused by your reliance on such third party information.


1. Wagering Account Application Requirements

1.1 Right to Refuse Service

Winners shall have the right at any time and for any reason to refuse to provide the Service, including but not limited to opening a wagering account, accepting any wager, accepting a deposit, or closing a wagering account.

1.2 Eligibility

1.2.1 Winners wagering accounts will only be established in the name of an individual meeting the criteria set forth below and are non-transferable.
1.2.2 Winners will not accept applications for corporations, trusts, partnerships, beneficiaries or custodial accounts.
1.2.3 Any individual prohibited from wagering by the Connecticut Department of Consumer Protection (“DCP”) shall be prohibited from establishing a Winners wagering account or placing a wager.

1.3 Requirements to Establish/Maintain an Account

1.3.1 General Requirements

Use of the Service in Connecticut is subject to all applicable Connecticut and Federal laws and regulations. You may only establish and maintain a wagering account if you are a natural person who is at least eighteen (18) years of age or older. By registering for or using the Service, you represent and warrant that:

  • You are a natural person who is eighteen (18) years of age or older;

  • You are a United States citizen or resident alien;

  • The residential address you provide is true and correct and you are a resident of the state associated with that address;

  • All registration information you submit is truthful and accurate;

  • You will maintain the accuracy of such information at all times, including your name, principal residence address, email address, and telephone number, and will promptly notify Player Services of any changes;

  • Your Account is for your own personal use only and will not be used in connection with a commercial business or for commercial purposes;

  • You will not permit any other person to access or use your Account.

  • If your primary residence address changes, you must notify Winners immediately and you agree not to use your Account until your new address has been verified.

1.3.2 Residency Requirements

  • You must be a resident of the State of Connecticut or one of the other states from which Winners accepts accounts, as posted on the Website.

  • Residents of states not on the list of eligible states may not open an online account or place wagers over the Internet, but may place wagers by telephone using the live operator (“Telebet”) or Automated Teller wagering services, where permitted.

  • If you move to a state that is not eligible, or outside of the United States, you must refrain from wagering.

1.3.3 Information Required

To establish and/or maintain a wagering account, you must provide:

  • Your full legal name;

  • Principal residence address;

  • Telephone number;

  • Social Security Number;

  • Date of birth; and
    f. A valid email address.

If you submit an account application in person at a Winners OTB location, you must also provide a completed Internal Revenue Service (“IRS”) W-9 Withholding Form.

1.3.4 Agreement to Terms

By opening an account, you acknowledge that you have read, understood, and agreed to abide by these Terms and Conditions, and you agree to pay all charges posted to your wagering account.

1.3.5 Authentication and Monitoring

  • You authorize Winners to use third-party services to authenticate your account information. All information used to authenticate your account will be kept confidential in accordance with applicable law.

  • Winners reserves the right, but not the obligation, to monitor the use of the Website and other Winners wagering services to determine and assure compliance with these Terms and Conditions or any lawful order of a governmental or judicial agency of competent jurisdiction.

  • Sportech Venues may, in its sole discretion, refuse to offer the Service to any person or entity and may change eligibility criteria at any time. This provision is void where prohibited by law and the right to access the Service is revoked in such jurisdictions.

1.4 Account Closure

Winners reserves the right to close any wagering account for any reason in its sole discretion. Upon closing a wagering account, all funds will be returned to the customer account holder via check mailed to the registered address on file with Winners.

1.5 Minimum Balance

A minimum balance of $1 must be maintained in an active account in order for the customer to receive racing information.

1.6 Mailing Address

The address provided by the customer account holder to Winners is deemed to be the proper address for the purposes of mailing checks, statements of account, wagering account withdrawals, notices, or other appropriate correspondence unless written notification is on file with Winners.

1.7 Exclusive Use

The wagering account is for the exclusive personal use of the named customer account holder only. No other person may wager or otherwise access the wagering account. The customer account holder agrees to notify Winners immediately of any unauthorized use of a customer wagering account, password, PIN or a registration profile.

1.8 One Account Rule

Only one wagering account per verified person will be allowed.

1.9 Identification

All customer account holders will adhere to the method or methods of identification that Winners may require in order to access a wagering account.

1.10 Account Number

Each wagering account will have a unique account number, which may be changed at any time by Winners so long as Winners informs the customer account holder in writing of such change.

1.11 Access Credentials

The wagering account may be accessed by the use of a username or an account number and a password or PIN (depending on the method of access) to be used by the customer account holder to confirm the validity of every wagering account transaction. The customer account holder will select a username, secret code or password and PIN upon opening the account. The account number is assigned by the Tote System. The username and the password are used to access the Website. The account number and Secret Code, PIN or password are used to verify the customer account holder’s identity when using the Telebet Service or the Automated Teller touch-tone telephone wagering service (PIN only), when using the wagering account at one of Winners’ Connecticut OTB venues or discussing the customer’s wagering account with a Winners Customer Service representative.

1.12 Lost Credentials

In the event that the customer account holder is unable to recall a wagering account number, password, Secret Code or PIN, Winners will use other identifying information to verify the identity of the customer account holder.

1.13 Credential Changes

Winners may change the password or PIN at any time without explanation so long as Winners informs the customer account holder in writing of such change. Customer account holders may change their passwords, Secret Codes or PINs by calling Customer Service.

1.14 Responsibility for Credentials

The customer account holder bears the responsibility for maintaining the secrecy of his or her wagering account number, Secret Code, PIN and password.

1.15 Responsibility for Wagers

Customer account holders will be responsible for all wagers placed through their wagering accounts by any person providing the correct identifiers and using the wagering account.

1.16 Prohibited Purposes

Wagering accounts may not be opened or used in any way for any illegal or improper purpose, including but not limited to:

  • Evading any reporting requirement;

  • Performing or hiding any criminal or illegal activity;

  • Bribery/gratuity, check fraud, credit/debit card fraud, embezzlement/theft, unusual use of checks or wire transfers or false or conflicting ID(s);

  • Attempting to wager on an event you cannot or are not supposed to wager on (such as a wager by or on behalf of a participant in the event such as a jockey);

  • Activity that does not represent legal gambling activity or does not have a valid business or lawful purpose; or

  • Activity that otherwise appears to be suspicious or not within normal wagering activity.


2. Account Procedures: Wagering, Deposits and Withdrawals

2.1 Wagering

2.1.1 Methods

Winners allows you to wager:

  • (i) with your Winners wagering account online (Connecticut residents only);

  • (ii) over the phone using the Winners Telebet Service; or

  • (iii) in person at a Winners off-track wagering branch.

2.1.2 Right to Refuse

Winners has the right at any time and for what it, in its sole discretion, deems good and sufficient reason to refuse to accept all or part of any wager.

2.1.3 Recording of Conversations and Transactions

  • All wagering conversations and Customer Service conversations shall be recorded by the Winners Customer Service center.

  • All wagering transactions shall be recorded, subject to regulatory approval, and stored for a period of time established by regulation, or a minimum of one (1) year.

2.1.4 Commingling

  • Winners commingles with all tracks.

  • In the event that there is a failure to merge pools with another track, according to state law, a separate Connecticut pool may be created and Connecticut odds will be paid.

  • Connecticut odds may differ from track odds.

  • If for any reason the wager is not commingled with the pool at the track or in a separate Connecticut pool, the wager will be refunded.

2.1.5 Payments

Payments on winning wagers will be posted as credits to the customer wagering account as soon as the race is declared official, barring technical difficulties. As a customer account holder, you are responsible for verifying proper credits and of notifying Winners if you identify a discrepancy.

2.1.6 Online Wagering (Connecticut residents only)

  • Go to the Website and sign in using your Username and Password.

  • This will bring you to the main wagering screen.

2.1.7 Wagering Over the Phone with Telebet

  • Account holders can place wagers with a live operator teller through the Telebet Service.

  • Call the Telebet number during operating hours and provide your account number and password or PIN.


2.2 Cancelling a Wager

2.2.1 Cancelling an Online Wager

  • A customer account holder may cancel online wagers that are no greater than $750 up to one (1) minute prior to post time for the race on which the wager was made.

  • The number of cancelled wagers by a customer may not exceed twenty (20) per calendar week. Other restrictions may apply.

Steps to cancel:

  1. Select “Menu”. (top right)

  2. Select "wager History".

  3. Click the live racing tab and active bets.

  4. Find the wager you would like to cancel.

  5. If the wager is eligible for cancellation, a red “Cancel” button will display. If ineligible, the button will not display.

  6. Select the “Cancel” button.

  7. Select “Confirm” to confirm the cancellation request.

  8. Cancellation rules are subject to change.

Alternative steps to cancel:

  1. Click on "bets" on the bet pad.

  2. Find the wager you would like to cancel.

  3. If the wager is eligible for cancellation, a red “Cancel” button will display. If ineligible, the button will not display.

  4. Select the “Cancel” button.

  5. Select “Confirm” to confirm the cancellation request.

  6. Cancellation rules are subject to change.

2.2.2 Cancelling a Telebet Wager

  • All Telebet wagers are final and no wager shall be cancelled by an operator after the wager has been accepted unless all wagers in the relevant pool are cancelled, or unless the request to cancel the wager is made during the single wagering conversation in which the wager to be cancelled was made.

  • When placing a wager through a Telebet operator, the operator will repeat your wager to confirm accuracy. Once the wagering conversation has ended, all wagers made during it are final.

2.2.3 Wager Cancellation Policy

For questions concerning Sportech’s wager cancellation policy, please call Customer Service.


2.3 Deposits

2.3.1 Available Deposit Methods
You may fund your MyWinners Account using the following approved methods, subject to applicable limits, fees, and Connecticut Department of Consumer Protection regulations:

  • Credit or Debit Card (Visa/Mastercard). Deposits are generally credited within minutes. Minimum transaction: $10; maximum $500 per transaction; daily limit $10,000. A processing fee of 3.5% may apply. Some issuers may classify deposits as cash advances, incurring additional fees.

  • Online Banking / ACH Transfer. Secure electronic funds transfer from your bank account. Minimum deposit is $10. Deposits may be held up to three (3) business days. Returned ACH deposits incur a $25 charge plus any applicable bank fees. Accounts may be locked for unresolved unpaid deposits.

  • PayPal. Deposits can be made using your PayPal balance or a linked bank card.

  • Cash App. Deposit funds directly from your Cash App account on your mobile device.

  • Bitcoin. Deposits may be made in Bitcoin, following the on-screen wallet transfer instructions.

  • PayNearMe. Generate a barcode and pay cash at participating convenience stores and retail outlets. Funds are credited once processed.

  • Cash at Wells Fargo. Cash deposits can be made directly at participating Wells Fargo branches.

  • Cash at Winners Locations (Connecticut Only). Cash, cashier’s checks, money orders, winning tote tickets, or vouchers may be deposited at authorized Winners OTB locations, accompanied by a completed deposit slip.

  • Mail Deposits (Connecticut Only). Personal checks, cashier’s checks, or money orders mailed with a signed deposit slip. Do not send cash. Checks must be payable to “Winners” with your account number in the memo field. In-state checks may be held up to three (3) business days; out-of-state checks up to five (5) business days.

  • Wire Transfer. Minimum deposit is $100. Funds are posted upon receipt.

  • Global Cash Access (Connecticut Only). Deposits may be made by calling Global Cash Access at (866) 230-0203. Service fee: 6% for transactions of $100 or more. Daily limit $1,000.

2.3.2 General Deposit Rules

  • Minimum initial deposit is $10.

  • All deposits are final. MyWinners maintains a no-return, no-cancellation policy. Deposited funds may only be accessed by placing wagers or submitting a withdrawal request in accordance with Section 2.4.

  • Deposits of $10,000 or greater will trigger IRS Form 8300 reporting requirements.

  • Account balances are non-interest bearing.

  • Accounts inactive for six (6) or more months may be closed.

  • Fees may apply depending on the chosen deposit method.

  • All deposits and associated records are subject to review by the Connecticut Department of Consumer Protection.

2.3.3 ACH Authorization and Electronic Signature
By choosing ACH transfer, you authorize MyWinners and its payment vendors to debit and credit your designated personal bank account in accordance with your instructions. You agree that:

  1. Your agreement to these ACH terms constitutes a legally binding electronic signature.

  2. You consent to electronic delivery of ACH disclosures.

  3. You authorize MyWinners (and its vendors) to make inquiries as necessary to validate your account, including credit reports or third-party verification.

  4. Business accounts may not be used for ACH deposits.

  5. Returned ACH deposits will result in a $25 fee plus any applicable bank charges.


2.4 Withdrawals

2.4.1 Methods

Depending on your Account settings, location, and the method of deposit originally used, the following withdrawal methods may be available:

  • ACH/E-Check – Direct transfer to your registered bank account.

  • Check by Mail – A physical check sent to your residential address on file.

  • Wire Transfer – Typically used for larger withdrawals and may involve fees or additional verification.

  • Prepaid Cards – Certain site-branded or approved Visa/Mastercard prepaid cards may support withdrawals.

  • In-Person at Retail Venue – Cash withdrawals are available at approved Winners locations for verified Accounts.

Not all withdrawal methods are available to every Account holder. MyWinners reserves the right to determine which methods are available based on your circumstances, deposit method, and applicable regulations.

2.4.2 Receipt of Withdrawal Checks

  • If sufficient balance exists, checks will be mailed first class.

  • If balance insufficient, request denied.

2.4.4 Withdrawals in Person at Retail Venue

  • Account number.

  • Proof of ID.


3. Password, Secret Code or PIN Changes

3.1 Customer Requests

Customer account holders may request to change their wagering account password online via the app or by calling Winners Customer Service toll free at (800) 468-2260.

3.2 Verification

Customer account holders will be asked for pertinent account information to verify their identity before any change is processed.


4. Closing an Account

4.1 Customer-Initiated Closure

To close your Winners wagering account, submit a written request including your account number, name, signature and address to:

4.2 Return of Funds

Any funds in the wagering account will be mailed in the form of a check to the customer account holder upon receipt of the written request.

4.3 Winners-Initiated Closure

4.3.1 Winners reserves the right to suspend or close any wagering account at any time.
4.3.2 Funds on deposit will be returned to the customer, less applicable service charges.

4.4 Inactive Accounts

4.4.1 Winners reserves the right to close wagering accounts inactive for six months or longer.
4.4.2 Prior notification will be sent before closure.

4.5 Service Charges

Upon closure, service charges may apply:

  • Balances of $6.00 or less: charge not to exceed $1.00/month.

  • Balances greater than $6.00: full balance returned.

4.6 Deceased Account Holders

Funds shall be released to the legal representative upon receipt of a valid death certificate and other required documents.

4.7 Transfer Prohibition

Ownership of a Winners wagering account may not be transferred to another person or entity.


5. Tax Reporting and Withholding

5.1 Reportable Winning Wagers

  • Winnings are reportable when:

    • $600 or more; and at least 300 times the wager.

  • Reported on IRS Form W-2G.

5.2 Federal Withholding

  • If winnings minus the wager exceed $5,000 and are at least 300 times the wager, federal income tax withheld at 25%.

  • If a correct SSN is not provided, withholding rate is 28% even if thresholds are not met.

5.3 Aggregation of Winnings

  • Identical wagers are aggregated for reporting and withholding purposes.

  • Tote System may withhold at 28%.

5.4 Connecticut Residents

  • Federal rules apply for Connecticut residents.

  • Connecticut Division of Revenue Services receives copies of all W-2G forms.

  • State tax withheld where applicable.

5.5 Statements

  • Winners will send Form W-2G where reporting/withholding applies.

  • Summarized tax information available upon written request.


6. Account Statements and History

6.1 Online Access

  • Account holders can access statements and full history (wagers, deposits, withdrawals, balances, year-end statements) online at any time via the Website.

6.2 Requests by Mail or Fax

  • Statements can be mailed or faxed by Customer Service upon request.

  • We can provide year-end statements to all customers upon request.


7. Live Video & Race Replays

7.1 Eligibility

  • Available only to customer account holders in good standing.

7.2 Fees

  • There are no fees for video and race replays but new customers must deposit and wager $25 in order to access the content.


8. Account Safety, Security and Player Responsibilities

8.1 Exclusive Use

  • Wagering accounts are for the personal use of the registered account holder only.

8.2 Responsibility for Credentials

  • Customer is responsible for maintaining secrecy of account number, username, PIN, password and other credentials.

8.3 Winners’ Disclaimer

  • Winners is not responsible for losses from unauthorized use.

8.4 Customer Guidelines

  • Keep account details secure.

  • Always logout when leaving computer unattended.

  • Contact Customer Service immediately if a breach is suspected.


9. Website Content

9.1 Third-Party Content

9.1.1 Certain information available on the Website may be provided by third-party suppliers independent of Winners.
9.1.2 This information may include views, opinions, and recommendations of such third parties.
9.1.3 Winners neither endorses such views or opinions, nor is responsible for availability, accuracy, currency, or reliability.
9.1.4 Inclusion of such information does not constitute advice or solicitation.
9.1.5 Winners and Sportech are not liable for any loss or damage caused by reliance on third-party information.


9.2 Hyperlinks

9.2.1 The Website may provide content, hyperlinks, and references to external third-party websites.
9.2.2 Winners is not responsible for the content of such websites. Access is at your own risk.
9.2.3 Winners neither endorses nor guarantees availability, accuracy, or reliability of third-party sites.
9.2.4 Winners and Sportech are not liable for loss or damage caused by reliance on third-party websites.
9.2.5 Links do not constitute endorsement or representation of third-party qualifications, services, products, or information.


10. Use of Equibase Data and Products

10.1 Proprietary Rights

10.1.1 Data used to create Equibase Products and TrackMaster® Products are proprietary and copyrighted by Equibase Company LLC and Axcis Information Network, Inc.
10.1.2 Unauthorized copying, modification, or distribution of such data is prohibited.
10.1.3 Users may be held legally responsible for infringement.

10.2 Transfer Restrictions

10.2.1 Equibase and TrackMaster® Products may not be transferred between computers.
10.2.2 Copies may not be distributed to third parties.
10.2.3 Derivative works may not be created.
10.2.4 Products are for personal use only and may not be sold, rented, or otherwise transferred.

10.3 Breach of Terms

10.3.1 Equibase and/or Winners may immediately terminate access upon breach.
10.3.2 Purchase or use of products constitutes acceptance of these Terms.

10.4 Charges and Payment

  • (a) All fees and charges debited from Winners account at prevailing rates.

11. Governing Law / Disputes

11.1 Jurisdiction

  • Winners is subject to Connecticut laws and regulations concerning customer disputes.

  • Telebet wagers: voice recording of acceptance is binding.

11.3.1 A printed version of the Terms and Conditions and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to the Terms and Conditions. You and us agree that any cause of action arising out of or related to the Service must commence within one (1) year after the cause of action arose; otherwise, such cause of action is permanently barred. You agree that the provisions in this paragraph will survive any termination of your Account or the Service.

11.3.2 You hereby specifically acknowledge, agree and consent that any suit, action, proceeding, dispute, controversy or claim (“Dispute”) arising out of or relating to these Terms and Conditions, the Application or the Service will be dealt with in accordance with the following procedures. All parties shall first attempt to negotiate a Dispute informally for at least thirty (30) days before initiating any arbitration. Such informal negotiations shall commence following the receipt of a notice in writing by one of the parties sent to the other. We will send our notice to your billing address and email you a copy to the email address you have provided to us. You may send any notice to us to the applicable operator address listed below.

11.3.3 If the Dispute is not resolved through informal negotiations, the Dispute (except those Disputes expressly excluded below) shall be finally and exclusively resolved by binding arbitration before a sole arbitrator. YOU UNDERSTAND THAT ABSENT THIS PROVISION, YOU WOULD HAVE THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL. Any arbitration will take place in New Haven County, Connecticut and shall be governed by the Commercial Arbitration Rules and Procedures of the American Arbitration Association (“AAA”) then in effect, shall be conducted using the English language, by one arbitrator with substantial experience in resolving intellectual property and commercial contract disputes, who shall be selected from the appropriate list of AAA arbitrators.

11.3.4 The determination of whether a Dispute is subject to arbitration shall be governed by the Federal Arbitration Act and determined by the arbitrator rather than a court. The prevailing party in any arbitration or other proceeding arising under these Terms and Conditions shall be entitled to receive reimbursement of its reasonable expenses (including reasonable attorneys' fees, expert witness fees and all other expenses) incurred in connection therewith.

11.3.5 Judgment upon the award so rendered may be entered in a court having jurisdiction or application may be made to such court for judicial acceptance of any award and an order of enforcement, as the case may be. Notwithstanding the foregoing, each party shall have the right to institute an action in a court of proper jurisdiction for injunctive or other equitable relief pending a final decision by the arbitrator.

11.3.7 The parties agree that any arbitration shall be limited to the Dispute between you and Sportech Venues, Inc. To the full extent permitted by law:

  • no arbitration shall be joined with any other;

  • there is no right or authority for any Dispute to be arbitrated on a class-action basis or to utilize class action procedures; and

  • there is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.

16. Pari-Mutuel Game Rules – General Framework

16.1 Scope

  • 16.1.1 This Section applies to all Games offered by the Company that operate on a pari-mutuel basis, including but not limited to live horse racing wagers, Reels & Jackpot Games, virtual sports, and contest-style pari-mutuel pools (collectively, the “Games”).

  • 16.1.2 All such Games are conducted exclusively under a pari-mutuel wagering model in compliance with Connecticut law. No Game outcomes are determined by random number generators.

16.2 Eligibility and Location

  • 16.2.1 Eligibility requirements set out in Section B of these Terms apply to all Games.

  • 16.2.2 We may require geolocation verification and proof of age or identity before accepting wagers or processing payouts.

16.3 Tokens purchased

  • 16.3.1 Tokens may be purchased with U.S. dollars using the methods we provide.

17.3 Jackpots

  • 17.3.1 Certain Games may feature progressive or pooled jackpots.
